Vehicle breaker fined £800 for waste offences


Mr Stephen Higgins (44) of Coolnasillagh Road, Garvagh, was fined a total of £800, plus court costs of £34, at North Antrim Magistrates' Court today for breaches of waste management legislation.

On 6 February 2012, officers from the Northern Ireland Environment Agency visited a site at 20 Boleran Park, Garvagh owned by Mr. Higgins, where a quantity of controlled waste in the form of end of life vehicles and parts of end of life vehicles was deposited. The site was operating as a vehicle breaking yard. Approximately 50 End of Life Vehicles was observed on site. The site did not have a licence to operate as an authorised treatment facility for End of Life Vehicles. Officers visited the site again on 10 May 2012 and found End of Life Vehicles and parts still on site.

Mr. Higgins pleaded guilty to 4 waste charges under The Waste and Contaminated Land (Northern Ireland) Order 1997. .

He was fined £200 under each Article 4(1)a charge and £200 under each Article 4(1)b charge of The Waste and Contaminated Land (Northern Ireland) Order 1997.

1. End of Life Vehicles are defined as vehicles that are categorised as waste. Waste is defined as anything that you discard, intend to discard or are required to discard.

2. Mr Higgins was found guilty under the following Articles of The Waste and Contaminated Order (Northern Ireland) 1997:

3. One charges under Article (4)(1)(a), for depositing controlled waste or knowingly causing or knowingly permitting controlled waste to be deposited in or on any land unless a waste management licence authorising the deposit is in force and the deposit is in accordance with the licence.

4. Three charges under Article 4 (1)(b) for treating, keeping or disposing of controlled waste or knowingly causing permitting controlled waste to be treated, kept, or
disposed of except, of except under and in accordance with a waste management licence.
