Licence summary

Under the Water (Northern Ireland) Order 1999, the consent of the Department of Environment is required to discharge any trade or sewage effluent (including site drainage liable to contamination) from commercial, industrial or domestic premises into waterways or water contained in any underground strata.

Types of discharge consents:

  • Sewage Discharged Under Emergency Conditions Consent
  • Trade Effluent and Site Drainage Discharge Consent
  • Fish Farming Discharge Consent
  • Sewage Effluent Discharge Consent

The information provided here is for the transfer of ownership of an existing discharge consent.

Eligibility Criteria Each application is assessed on its own merit, and determined providing all relevant information is supplied.
Regulation Summary

Under the Water (Northern Ireland) Order 1999, the consent of the Department of Environment is required to discharge any trade or sewage effluent (including site drainage liable to contamination) from commercial, industrial or domestic premises into waterways or water contained in any underground strata.  

It is an offence under the terms of the Water Order to discharge such effluent without consent, and also to contravene any condition of a discharge consent. The penalty for either of these offences on summary conviction is imprisonment for a term not exceeding 3 months, or a fine not exceeding £20,000, or both.

Application Evaluation Process

The stages of the consent setting process are as follows:

  1. application received and checked
  2. consultation with statutory consultees, including district councils and Natural Heritage of NIEA
  3. advertisement in local press (paid for by the applicant)
  4. public consultation
  5. representations/objections considered (if applicable)
  6. draft consent conditions (DCCs) drawn up
  7. consultation on DCCs with statutory bodies (Loughs Agency, Fisheries Division of Department of Culture, Arts and Leisure)
  8. DCCs issued to the applicant
  9. final Water (Northern Ireland) Order 1999 consent issued

Will Tacit Consent Apply Tacit consent is where a licence is granted by default if the Licensing Authority has not processed your application within the published processing times. However, due to environmental / public health interests, tacit consent does not apply to applications for commercial and industrial discharge consents. Please contact NIEA, if you have not heard from us within a reasonable period of time from the date you submit your application.
Target Completion Period

Your application will be acknowledged within three working days of receipt.

Depending on the complexity of your application it will be processed within four months unless a time extension is agreed with you. If your application is refused you will be told how to appeal.
