Licence summary

Under the EU Waste Framework Directive, excess soil removed from development sites is regarded as waste and as such is required to be regulated by the waste management controls as provided for by the Waste Management Licensing Regulations (Northern Ireland) 2003 (as amended) and the Controlled Waste (Duty of care) Regulations (Northern Ireland) 2002 (as amended).

How do I demonstrate compliance with the guidance?

You should complete the declaration form in full and submit it to us prior to the movement of any soil. No formal response will be given by us but you should retain the paperwork for at least two years as it may be audited by us to ensure full compliance.

There is currently no fee for this registration.

Eligibility Criteria Anyone who moves clean, greenfield soil within Northern Ireland in accordance with the our greenfield soil guidance.
Regulation Summary This guidance removes the regulatory controls from the movement of clean greenfield soil providing full compliance is demonstrated. Details of how you can comply are contained within the guidance document.
Application Evaluation Process We will not actively evaluate every declaration form but will perform ad hoc audits of the activities. It is your responsibility to ensure that you comply with guidance.
Will Tacit Consent Apply? Once you have submitted your fully completed declaration form and have satisfied yourself that you have complied with the guidance you may move soil. No formal response will be issued by us.

Failed Application Redress It is your responsibility to satisfy yourself that you have complied with the guidance. Enforcement measures may be taken if you are found to have moved soil outside of the scope of the guidance.
