Graduated Fixed Penalty, Financial Penalty Deposit and Immobilisation Schemes
Implementation of Graduated Fixed Penalty, Financial Penalty Deposit and Immobilisation Schemes (GFP&DS) will fill a gap in the enforcement of road traffic law, resulting in increased compliance and improved road safety, and will bring NI into line with GB where the schemes are already operational
GFP&DS will enable:
- DVA vehicle examiners to issue fixed penalties notices (Phase 1);
- the graduation of fixed penalties so that they can be made proportionate to the severity of offending (Phase 2);
- the police and DVA to collect financial penalty deposits from offenders without a satisfactory UK address (Phase 3); and
- the immobilisation of vehicles in certain cases (Phase 3).
Phases 1 and 2 of GFP&DS are now operational. The legislation for Phase 3 was made on 26 January 2012 and will come into operation on 23 April 2012.
